Please read these Advertising Terms (hereinafter: "Terms") carefully because they contain important information about your legal rights and obligations. The web portal Laganini.com and all related domains and subdomains are private property and by accessing or using Laganini, you agree to comply with and be bound by these Terms. We reserve the right to change, amend or update the Terms of Advertising and other terms of business without prior notice.

Accuracy and veracity of advertised accommodation data

The host is the owner of the advertised accommodation or is the authorized representative of the owner and has all the documentation necessary to rent accommodation.

The host is responsible for advertising its products and services in accordance with the Consumer Protection Act.

The host is fully responsible for the data, materials and content published on Laganini and guarantees their accuracy, completeness and truthfulness, as well as the quality, safety and legality of the advertised products and services.

The host is also responsible for regularly updating and modifying the data, material and content of its ad through the user interface, if there is a significant difference between the published content and the actual situation.

The host is obliged to make all significant changes about the object through the user interface or inform the site administrators about them by sending an email or message via the contact form within 30 days of such change.

Copyright

Zephyr d.o.o. ("Zephyr") respects copyright law and expects Laganini users to do the same. If you own the copyright or are authorized to act on behalf of the copyright owner and you find a suspected copyright infringement on Laganini, report it by sending a notice to Zephyr. Upon receipt of the notice, Zephyr will take appropriate action, including removing the reported material and content from Laganini.

The host is responsible for the information, materials and content it publishes on Laganini, including multimedia content (photographs, videos, etc.) and confirms that it owns the copyright to the published content.

By posting ads on Laganini, the host permanently and free of charge licenses Laganini to use the uploaded content and materials (photos, videos, texts, etc.) for promotional purposes.

The host unconditionally releases Laganini from any liability for copyright infringement that may result from the use of content and materials published by the host.

In the event of a copyright dispute arising from the content and materials posted by the host or user, the dispute will be resolved directly between the copyright owner or the person authorized to represent the copyright owner and the user/host. Zephyr is not responsible and cannot be held responsible for any damage resulting from the content or materials transmitted by users or hosts. In the event that Zephyr suffers financial damage or any expense arising from materials and content posted by the user or host, the user or host agrees to reimburse Zephyr in full for the damage suffered. Disclaimer also applies to other content and materials posted by the user or host on Laganini (including content and materials for points of interest, etc.).

Users understand that content and materials from any part of Laganini may not be reproduced without the permission of the copyright owner.

Compliance with the Law on Prohibition and Prevention of Unregistered Activities

Pursuant to Article 7, paragraph 2 of the Act on the Prohibition and Prevention of Unregistered Activities (OG 6/11, 66/19), the client (host) is obliged to provide information about his/her identity when registering and entering advertisement, including: (i) name, address, OIB, name and surname of the responsible person for legal entities or (ii) name and surname, OIB and residence, i.e. residence for private persons. Furthermore, in accordance with Article 7, paragraph 3 of the Act on the Prohibition and Prevention of Unregistered Activities, the publication of advertisements is prohibited if the client does not submit the data referred to in Article 7, paragraph (2).
If the client or the host did not previously provide the mandatory information about their identity during registration and entering the ad, the host or the client undertakes to enter the same in the shortest possible period.
Zephyr is not responsible and cannot be held responsible for any damage caused by hosts as a result of non-compliance with legal regulations. In the event that Zephyr suffers financial damage or any expense resulting from the non-fulfillment of legal obligations by the client or host, the client or host agrees to fully compensate Zephyr for the damage suffered.

Terms for advertising on Laganini.com and ApartmanInfo.hr portals

On Laganini.com, ApartmanInfo.hr and all related domains and subdomains, any private landlord (host) who meets the following conditions/criteria can advertise accommodation:

• The host is the owner of the advertised accommodation object or is the authorized representative of the owner and has all the documentation (Categorization of accommodation) required to rent accommodation
• ad has to be complete, i.e. all required data must be entered as well as photos of the object and accommodation units
• entered photos must be high resolution and high quality (minimum 500x500 resolution), and photos that have nothing to do with the ad, the accommodation, and the place where ad is are not allowed (e.g. a photo of a tropical beach)
• personal information of the owner must also be entered and have to be correct and accurate (first and last name, PIN, mobile/phone number, exact address, profile photo and possibly links to own website and social networks)
• the host (renter) must duly and within a reasonable period respond to all incoming guest inquiries , messages and phone calls
• the host (renter) must update the ad (price list and photos) to make the information as accurate as possible and to make it easier for guests to search for accommodation
• the host (renter) must update the Availability Calendar, i.e. synchronize the Availability Calendar or enter occupied periods so that the displayed information is as accurate as possible and to make it easier for guests to search for accommodation
• the host (renter ) must log into the user interface at least once a yearto update the ad (price list, availability, photos) and to confirm that the ad is active
• host (renter) may not enter the same ad two or more times or if is the owner of several accommodation objects register with several different email addresses and thus enter more ads (accommodation objects)
• in case the host no longer rents accommodation, he/she is obliged to deactivate the ad or contact the administrator within 30 days of the termination of the rental object in order for the ad to be deactivated

In case of violation of any of the above conditions/criteria, the newly entered ad will not be approved, and the active ad will be deactivated and deleted. Laganini reserves the right to deactivate the ad without prior notice to all hosts (renters) who do not adhere to the stated rules and guidelines, and in severe cases of violation of the stated rules and guidelines, permanently delete the ad and user account.

Administering content on Laganini web portal

In order to provide correct, complete and useful information for users and to enable the efficient operation of Laganini web portal without interruption, if the need arises, Laganini administrators have the discretion to make corrections, changes and additions to ads, as well as discretion to remove or delete ads from Laganini's offer. Administrators authorized by Zephyr may do so in the following situations:

• when the ad data is incomplete, inaccurate, outdated or misleading
• when one ad or accommodation unit has been entered more than once
• when the advertisement contains discriminatory, offensive, inadmissible and prohibited materials and content
• when the advertisement promotes illegal services and/or accommodation
• when the advertisement reduces the quality and performance of Laganini
• when the content and materials presented in the ad do not reflect the actual situation

Although the administrators of Laganini have the discretion to make corrections, changes, and additions to advertisements, the host remains fully responsible for all data, materials, and content published within his advertisement on Laganini and guarantees their accuracy, completeness, and truthfulness, as well as quality, safety, and legality of advertised products and services.

In the event that Laganini's administrators have corrected, modified, removed or deleted the ad, Zephyr cannot be held responsible for any direct or indirect damage, including any lost profits.

Liability

Zephyr cannot guarantee that Laganini web portal will work uninterrupted or error-free. In the event that Laganini web portal is interrupted or slowed down due to errors, Zephyr cannot be held liable to the hosts for any direct or indirect damages, including any lost profits.

Termination of the advertisement

If Zephyr receives complaints from users or guests that in the case of a particular ad the presented content and materials do not match the actual situation or if it repeatedly receives user complaints against the host, we reserve the right to remove the ad and disable such host's account without prior notice. If the host attempts to enter inappropriate material into the database or repeatedly misuses the platform, Zephyr reserves the right to refuse and delete such advertisement and cannot be held liable for possible damages.

Changes in advertising conditions

Zephyr reserves the right to change the general terms and conditions of advertising on Laganini without prior notice.
